legal mortgage : a term used in Louisiana. The law alone in certain cases gives to the creditor a mortgage on the property of his debtor, without it being requisite that the parties should stipulate it. That is called “legal mortgage.” It is also called tacit mortgage, because it is established by the law without the aid of any agreement. Persian encompasses any fashion of mortgage consistent with the laws of the state and actionable at Iranian courts, and although the laws of the state entitle the judgment creditor to attach the property of the debtor upon his default they do not entitle the creditor to a mortgage of the landed property of a judgment debtor without having previously signed a valid mortgage deed. The Iranian law, in essence, does not automatically give to the creditor a mortgage on the property of his debtor without an express mortgage deed between the two of them. English also called tacit mortgage and statutory mortgage.
